How Do I Fill In A D84 In Divorce Proceedings

The D84 form is used to apply for the conditional order in divorce (formerly known as Decree Nisi).

When completing the application for a divorce order, the applicant must provide full names, including any middle names, of both the applicant and the respondent. These names can differ from those on the marriage or civil partnership certificate, and if a name has changed, a copy of the change of name deed must be attached or an explanation provided. If the evidence is not provided the court will likely refuse the application.

You are asked to confirm and the particulars of the facts relied upon in the divorce application if you are applying under the pre 2020 divorce law. It is crucial that you carefully review and verify the accuracy of all the information provided.

Along with the D84 form, if you applying under the pre 2020 divorce law, you must submit a statement in standard form, verified by a statement of truth. This statement should contain prescribed information relevant to your case, such as any correcting or updating information from the initial petition, and the acknowledgment of service signed by your spouse (if applicable). The appropriate form from the D80A to D80E series, corresponding to the specific fact relied upon in your divorce petition, must be used for this statement. If any of the details of your case need to be updated, do so on this form.

Once you have completed the D84 form and gathered all the necessary supporting documents, you will need to submit them to the court. This can either be done electronically or through the post. There is no court fee payable for this application.

It is important to note that the court will carefully review the submitted documents and may request further evidence or clarification if necessary. If the court is satisfied with the evidence provided and finds that you are entitled to a decree of divorce, a decree nisi will be pronounced.

The application will ask you if you wish to proceed with a conditional order and it will ask you if all the information in your application is still correct. If not, the portal will allow you space to highlight the information that needs to be updated.
