What is Managed Divorce?
We'll help you with the divorce paperwork to secure your final order of divorce. We offer a fixed fee divorce service
Although it is always better to resolve matters by agreement where possible, you do not need your spouse’s consent to get a divorce. The only ground for a divorce is a statement by one of the parties to the marriage that it has irretrievably broken down.
A divorce can only be defended on very limited grounds namely that:
- The jurisdiction of the courts England and Wales is disputed.
- The validity of the marriage or civil partnership is disputed; or
- The marriage or civil partnership has already been legally ended.
If you and your spouse can come to agreements on child arrangements, spousal support and division of property, our family law solicitors will also be able to finalise the additional paperwork for you, without the need to attend court or our offices. We can talk to you about the extra work and fees in sorting out these documents.
Financial Settlements
It’s important to recognise financial settlements are separate from the divorce process and, therefore, financial settlement advice is not included in a managed divorce service.
The financial aspect of divorce is typically more time-consuming, as the divorce process itself is normally much quicker, in comparison to disputed financial claims.
We can provide you with ongoing legal advice to reach a financial settlement or to represent you in court proceedings for a financial court order. We can explain what level of support we believe you need, and the costs and timescales, depending on your circumstances.
Clean Break Order
If an agreement on finances has already been reached with your husband or wife, to protect you financially and give you peace of mind in the future, our family solicitors can draft a clean break financial order on your behalf and file it with the court. We also offer fixed fees for this service.
A clean break order is the only way divorced couples can ensure that no further claims can be made against them after the divorce has been finalised.
This type of financial order will help to protect your property, inheritance, and pensions from any future financial claims being made by your former spouse.
If you decide not to obtain a clean break order, your ex-spouse is within their rights to request financial assistance further down the line, regardless of whether you have been divorced for ten or twenty years.
