Divorce
To obtain a divorce, you must have been married for at least one year, and be able to prove that your relationship has irretrievably broken down by citing one of these five facts:
- Adultery
- Behaviour
- Desertion
- Separation of two years with consent
- Separation of five years without consent
However, from 6th April 2022, you will be able to apply for a ‘no-fault divorce’ which means that you can divorce without having to apportion blame for the marriage breakdown.
Regardless of your reasons for getting a divorce, we will discuss the divorce process with you, step by step, and make sure you get the advice you need on children law arrangements and financial settlements.
Children and Divorce
If you and your partner divorce, the important decision around where any children may live can be a difficult one to resolve.
We will work collaboratively with you and your former spouse to come to amicable arrangements on matters, such as:
- Decisions regarding which parent your children will live with and contact arrangements
- Financial arrangements for the children and child support
- Practical parenting issues such as decisions on which schools the children should attend
If your children are living with you, you may wish to apply for child maintenance for your children.
We can help parents to work together to agree on the amount of maintenance between themselves. If this is not possible, an application can be made to the CMS (Child Maintenance Service), a government-run agency that can calculate and collect child maintenance payments. The amount you will receive in child support will be based on the CMS child support formula.

Divorce Settlements
One of the biggest worries separating couples may have when they divorce is how to divide their assets and protect their finances.
A Divorce Settlement is an agreement between you and your spouse that separates your money, assets and property. If you cannot reach an agreement, you or your spouse could apply to Court for a Financial Court Order.
Every family situation is unique and will be treated as such by the Courts. Some of the assets you may be entitled to receive include:
- Money including savings, investments or business assets
- Property including the transfer of the family home
- Pensions
- Spousal maintenance
A fair settlement should be ordered by the Court without prejudice to gender. A woman may be able to claim spousal maintenance, particularly if the husband has been the higher earner within the relationship or the woman has experienced career disadvantage through being the children’s primary carer, and will continue to do so after the divorce.
