What is domestic violence?

There are a number of things which constitute domestic violence in legal terms:

  • Abusive violence between couples living together
  • Abuse between partners who do not live together
  • Harassment by former partners
  • Abusive relationships between parents and children
  • Abuse against elderly family members
  • Abuse between tenants or flat mates
  • Female genital mutilation (FGM) or forced marriage

How long does it take for a divorce to go through?

A divorce can take between 6-8 months if not disputed. If the divorce or finances are disputed, this timescale can be much longer, depending on when such issues are resolved.

My partner and I are not married; what happens if we split up?

In the UK, the law doesn’t recognise what is often called 'common law' partners. When unmarried couples split, they usually have assets together. Without the legal framework that married couples have access to, good legal advice from a family law specialist is vital in achieving a fair and equitable resolution – especially if children are involved.

What happens if we cannot agree with whom the children should live?

The focus must always be what is in the best interests of the children. If this cannot be agreed upon, the court will decide for you. You are certainly encouraged to attend mediation before this stage.
