What is mediation and its benefits?

Mediation is a confidential environment where the mediator acts as an independent impartial aid to the conversation and helps people reach agreement on issues they cannot discuss themselves for a variety of reasons.

Mediation Benefits

There are numerous advantages to family mediation over traditional methods of resolving issues such as court or solicitor negotiation.

Mediation can be quicker, less stressful and more cost effective than going to court. It is a voluntary process and enables people to have control in their decisions which will have a big impact on their future and empowers people to make decisions that are right for them and their families, rather than decisions being imposed on them by a Court.

Mediation provides a safe and confidential environment where various options can be explored and tested in detail before people agree on the outcomes and next steps. It allows people a safe space to explore a variety of ideas before deciding on the best option for all involved. People are free to go away in between mediation sessions and test ideas out or seek additional expert advice from a solicitor or financial advisor for example. Mediation proceeds on a time phrase and schedule that is agreed between the parties rather than forced on people by a Court.

The mediator cannot provide legal advice, but it is helpful to select a mediator who is also dual qualified as a family law solicitor because they will have an understanding of the legal processes and can help guide you through mediation in light of this.

The mediator will explain the process to you and guide you through it. If mediation is appropriate, then most people find that between 3- 5 sessions is enough to resolve matters. People are free to talk about any element of their family issues in mediation such as separation, divorce, finances for example the family home and the children.
