Amicable Child Arrangements and Divorce Financial Settlements

Amicable No-Fault Divorce

In 2022 no-fault divorce law was introduced to try and make sure that the divorce process in England is as amicable as possible.

With a no-fault divorce, you do not have to say that your husband or wife is at fault or say that they have committed adultery or behaved unreasonably. You also do not have to be separated from your husband or wife for a specified period before you can start divorce proceedings. All you have to do is apply to the court for a divorce and provide a statement that the marriage has irretrievably broken down.

In no-fault divorce proceedings, you can make a joint application for a divorce or one of you can make the divorce application. Whether the divorce application is a joint application or an individual application:

  • The divorce can be amicable
  • The court process is very similar
  • The timescale to finalise the divorce is similar

As a no-fault divorce does not blame a husband or wife for the marriage breakdown, there are only limited grounds to challenge a no-fault divorce. For example, if there are already ongoing divorce proceedings overseas because you are an international family or if one of you says that the marriage is not legally valid in the UK because the ceremony was a religious marriage that is not recognised as a marriage under UK law.
